The decision of whether to accept a plea offer from the prosecution is made by the defendant. This decision is made based on the facts of the case and the law that applies to any given prosecution. The lawyers’ job is to develop facts and apply the law that will work to the defendant’s benefit. Sometimes, the plea bargain offer is so bad that the only decision left is to take the case to trial and let a jury decide guilt or innocence. There is no hard and fast rule regarding the acceptance of a plea bargain offer. The lawyer should give the defendant all the options and his or her best advice, but the defendant will be the ultimate decision maker in whether to accept a plea or go to trial.
